If you have worked for over a year (and a minimum of 1,250 hours during that year) for your employer who employs at least 50 employees, you are allowed 12 unpaid workweeks of leave in a 12-month period for a protected medical reason under the Family Medical Leave Act (FMLA). Protected medical reasons include the birth or adoption of a child, or caring for yourself, a spouse, child or parent with a serious health condition, so long as you provide your employer with sufficient notice.

It is against the law for an employer to retaliate against you for requesting or taking time off under FMLA. If you and your employer are eligible and you exercise your rights under the FMLA, your employer cannot do any of the following:

  • Cease your healthcare benefits while on leave
  • Deny your request for time off
  • Terminate you or not restore you to the same or similar position upon return from leave
  • Use your leave time against you during employment reviews
